TERMS OF SERVICE

1. Club overview
Kilturka is an offline esports and gaming club in Manchester offering in-person gaming stations, single-visit admission, memberships and organised activities. These Terms govern your use of the club, our website, memberships, bookings and activities.
2. Applicability of these Terms
By visiting the club, buying admission or a membership, booking a station, or joining an activity, you agree to these Terms. They apply alongside our Privacy Policy and club rules.
3. Visitor and member eligibility
Membership and admission are open to individuals aged 13 and over. You must provide accurate information and, where asked, proof of age.
4. Participation by minors
Members and visitors under 18 may use the club subject to these conditions: those aged 13–15 must have written consent from a parent or guardian, and we may require a parent/guardian to be contactable during the visit. We reserve the right to set additional conditions for under-18s and to restrict certain age-rated content.
5. Single visits
A Single Visit costs £10 and grants one day’s admission, use of communal areas and one gaming station subject to availability (up to three hours at peak times). Single visits do not include members-only benefits.
6. Weekly memberships
A Weekly Membership costs £20 and provides seven days’ access from activation, station reservations up to two days ahead, included entry to member activities and reduced fees on the few paid sessions.
7. Monthly memberships
A Monthly Membership costs £35 and provides one calendar month of access, priority station booking up to five days ahead, free or reduced activity entry, and full members-only access.
8. Annual memberships
An Annual Membership costs £330 and provides twelve months of access, the longest booking window, first pick of limited-place events and all monthly benefits.
9. Membership activation
Membership begins on activation in the club or on the confirmed start date you select at purchase.
10. Membership duration
Weekly lasts seven days, monthly one calendar month, and annual twelve months, each from activation.
11. Membership renewal
Memberships are fixed-term and do not renew automatically. When your term ends, access stops until you choose to renew. We do not take recurring payments and will not charge you again without a new purchase decision by you. We may send an optional reminder before your term ends.
12. Membership cancellation
You may cancel at any time by emailing info@kilturka.com. Because memberships do not auto-renew, cancelling simply means you won’t renew; your access continues until the end of the paid term unless a refund applies under sections 21–23.
13. Prices
All prices are in pounds sterling (£) and include VAT where applicable. We may change prices from time to time, but changes never affect a membership or booking you’ve already paid for.
14. Payments
Payment is taken at the time of purchase through our payment provider. We do not store full card details. If a payment fails, the related admission, membership or booking may not be confirmed.
15. Gaming station reservations
Stations may be reserved online or in the club, within the booking window for your access level. Reservations are subject to availability. Please arrive on time; we may release an unclaimed station a reasonable period after the start.
16. Facility access
Access is subject to these Terms, our club rules and opening hours. We may refuse or withdraw access where conduct, safety or capacity requires it.
17. Activity bookings
Places at activities may be limited. Book online or in the club. Some activities are members-only, and a small number carry a separately stated fee.
18. Booking confirmation
Bookings are confirmed once you receive our confirmation. Please bring it (or your membership) to the club.
19. Paid activities
Where an activity carries a separate fee, the price is shown before you book. Paid activities are optional.
20. Rescheduling
You may ask to move a booking, and we’ll accommodate this where places allow. We may occasionally reschedule an activity and will give as much notice as possible.
21. Cancellations
If we cancel a separately paid activity, you may choose a transfer to another date or a full refund of that fee. If we cancel due to circumstances within our control, we’ll always offer a refund option.
22. Refund conditions
Refunds are provided where required by law or these Terms. Included (non-separately-charged) activities carry no fee to refund. Separately paid activities cancelled by us are refunded in full. For memberships, refunds follow your statutory cancellation rights (section 24) and any deduction for services already used.
23. Consumer rights
Nothing in these Terms affects your statutory rights. Under the Consumer Rights Act 2015, our services will be provided with reasonable care and skill. If a service falls short, you may be entitled to have it put right or to a price reduction.
24. Cancellation rights for distance contracts
Where you buy a membership online or otherwise at a distance, you have a 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, during which you may cancel for a refund. If you ask us to start your membership within the cooling-off period, and then cancel, we may deduct a proportionate amount for the access you’ve already used. You do not automatically lose this right simply by buying or activating a membership.
Please note a legal exception: contracts for leisure services tied to a specific date or period — for example, a single-visit day pass for a chosen date, or a place at a dated activity — are exempt from the 14-day cooling-off right under these Regulations. Where the exemption applies, we’ll make this clear at the point of purchase. This does not affect your rights if the service is faulty or not as described.
25. Club opening hours
Current opening hours are published on our Contact page. We may vary hours for holidays, maintenance or events and will give notice where we can.
26. Changes to facilities and schedules
We may change facilities, equipment, activities or schedules to improve or maintain the club. Where a change materially affects something you’ve paid for, we’ll offer a suitable alternative or refund.
27. Member responsibilities
Members must follow these Terms and club rules, respect staff and other members, use equipment responsibly and keep their membership details up to date.
28. Visitor and guest responsibilities
Visitors and guests must follow the same rules and staff instructions while at the club.
29. Club rules
No food or drink at the stations; no tampering with hardware, settings or networks; no unauthorised software; and no disruptive behaviour. Age-rating restrictions apply to relevant titles.
30. Code of conduct
We expect courteous, inclusive behaviour at all times. Harassment, discrimination, threats or abusive conduct — online or in person — may result in removal without refund.
31. Fair play principles
Cheating, exploiting, account misuse and unsporting behaviour are prohibited. Activities are for enjoyment and practice only.
32. Appropriate use of gaming equipment
Use equipment for its intended purpose and follow staff guidance. Report faults rather than attempting repairs.
33. Personal peripherals
You may bring your own wired USB peripherals. You are responsible for your own equipment; we accept no liability for loss or damage to it except where caused by our negligence.
34. Responsibility for deliberate or negligent damage
You are responsible for the reasonable cost of repair or replacement of club equipment you damage deliberately or through negligence. This does not affect your statutory rights and applies only to your own fault, not fair wear and tear or faults not caused by you.
35. Technical interruptions
Occasional technical issues may occur. We’ll help promptly, move you to another station where possible, and, for separately paid activities materially disrupted by a fault on our side, offer a transfer or refund.
36. Internet connectivity
We provide wired connections at PC stations and Wi-Fi in the lounge. While we work to maintain a reliable service, we cannot guarantee uninterrupted connectivity, as some factors are outside our control.
37. Personal belongings
You are responsible for your belongings. Lockers are provided; please use them. We are not liable for loss or damage to personal items except where caused by our negligence.
38. Intellectual property
The Kilturka name, website content and branding belong to us or our licensors and may not be used without permission.
39. Third-party games and services
Games, platforms and services from third parties are subject to their own terms. We are not responsible for third-party content, availability or account matters.
40. Disclaimer of results
Club access, practice, activities and memberships are for enjoyment and skill development. We do not guarantee improved rankings, tournament victories, professional esports careers, team contracts, prizes, financial benefits or any specific performance results.
41. Website availability
We aim to keep our website available but cannot guarantee it is always accessible or error-free, and may suspend it for maintenance.
42. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for indirect or unforeseeable losses. Our liability for any paid service is limited to the amount you paid for it. Your statutory consumer rights are unaffected.
43. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, such as power failures, network outages, extreme weather or emergencies. Where such an event materially affects a paid service, we’ll offer a suitable alternative or refund.
44. Governing law and jurisdiction
These Terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in your own jurisdiction.
45. Complaints procedure
Please raise any complaint with us at info@kilturka.com. We’ll acknowledge it promptly and work with you to resolve it fairly. This does not affect your statutory rights or your right to contact the ICO on data matters.
